Update on Mayor’s Executive Directive [ED 1] Draft Ordinance — time is now to comment

Hi All,
Here is the latest news on the draft Ordinance for ED 1.  It will go before the City Council PLUM committee on March 19.  Our guidelines have been vetted by the Mayor’s office and Planning but they must now be introduced as amendments to the draft ordinance at the upcoming PLUM meeting by a committee member.  The mayor’s office is prepared to offer language for any or all the guidelines that are introduced.  There are 5 councilmembers that sit on PLUM; Harris Dawson, Yaroslavsky, Padilla, Hutt, Lee.   We have contacted all of them and shared our guidelines.  We have meetings with two already set up.  Our goal is to speak with each of them and get one or more of them to introduce the amendments. We have already sent our guidelines and request for support to the mayor and her deputy mayors and to the Planning Director and his staff.
Here are our next steps:1.) Jeff, Cindy and I will continue to meet with PLUM members.  If any of you have a special connection with any of them please reach out to us.  We may need you to be on our call. 
2.)  We would like all HOAs to send a statement supporting the guidelines to the council file CF 23-0623.  ASAP
3.)  We would like Neighborhood Councils to submit CIS reports (see below) hopefully in support of the guidelines to the council file CF 23-0623. ASAP
4.)  We will do a letter writing campaign directly to the Mayor and our council members.  ( about 2 weeks from now)
5.)  Reach out to your councilmember not on PLUM, that might introduce any amendments that are not yet added. ( about 2 weeks from now)
Hope that helps everyone understand what we need to do.  Meanwhile we are still waiting for the Housing Element maps to be released.  And we are starting to have meetings with our different district groups that we worked on community maps with.  Just to stay in contact.
We have attached the guidelines for ED 1 again for your convenience and a sample letter below to be used for your council file submission.  Feel free to use or craft your own. 

The ________Neighborhood Council supports the ED 1 Ordinance  ( CF 23-0623) if amended to include the guidelines sent by United Neighbors to the PLUM committee, with a particular focus on the importance of the following amendments: 1. Limit the number of waivers and off menu incentives to a total of 6; 2. Require rear 15’ setbacks to allow for trees to grow and storm water to be captured; 3. Prevent post-development conversion of nonresidential spaces to market rate units; 4. Protect R 1, HPOZs  and Historic Districts in their entirety; 5.Ensure that substandard streets/ high-fire zones do not qualify for ED 1 fast track approval; 6. Require ED 1 projects meet minimum Tier 2 TOC qualifications.  Projects that don’t meet these requirements under ED 1 would need to go through discretionary approval. This can be used as well by HOAs just use your HOA’s name at the start. Again it is important we do this asap.  Your community statements can be written any way your group deems appropriate.  But let’s get this done now.Thank you all!  Maria, Cindy, Jeff

We know some of you don’t like Executive Directive 1 (ED 1).  The mayor’s directive is supported by the city and the mayor.  They have seen over 100 projects being submitted that can lead to several thousand affordable units. They see this as a huge success. But the Directive has no guidelines so we are seeing projects that are hugely problematic with no way to stop them. Our best hope for containing some of the damage the more aggressive projects can inflict on our communities is to add guidelines to this directive.  The Draft Ordinance for ED 1 has already been approved without guidelines by the Planning Commission, it now comes to the PLUM committee of the city council. At this meeting, committee members can suggest guidelines.  We feel that if we can get these guidelines in the draft it will go a long way in helping prevent the more outrageous projects from being fast tracked. Fast track approval eliminates public hearings while discretionary does not.  We want good projects to go through the fast track process and the problematic projects to go through discretionary review.  It is fast tracking that saves developers time and money and makes this directive a city success.

We need to be united in our efforts to get these guidelines approved. We worked collaboratively with the mayor’s office so they understood which guidelines we needed and we learned which they object to. If we don’t get these guidelines introduced by a member of the PLUM committee then this ED 1 Ordinance will proceed to a full Council vote for approval.  The city council is not going to vote against this Ordinance but they could approve guidelines.

We need everyone submitting to the council file whether you are an HOA or Neighborhood Council or an individual. This is critical. Your comments in the council file may help convince a council member to introduce the guidelines. 

We, in the meantime, will continue to try and set up face to face meetings with PLUM members.

Mayor Bass made an interesting statement after returning from a trip to Sacramento where she was asking for more money and I think it is something that really can apply to us.
